TITAN FENCING LIMITED WARRANTY FOR FENCE AND RAIL PRODUCTS
 

WHO AND WHAT ARE COVERED BY THIS WARRANTY

This warranty is extended to (1) the original purchaser, or (2) the property owner(s) at the time of installation, if not the original purchaser (collectively referred to as the “Purchaser”) of vinyl fence and rail profiles manufactured by TITAN Fencing (“TITAN”). For the purposes of this warranty, a “Residential Purchaser” is defined as a single-family residential homeowner, and a “Commercial Purchaser” refers to any Purchaser that is not a Residential Purchaser. Subject to the exclusions and limitations herein, TITAN Fencing guarantees to the Purchaser that its vinyl fence and rail profiles (the “Products”) will be free from manufacturing defects, including peeling, flaking, blistering, rotting, and corroding, under normal and proper use.
 

WARRANTY PERIOD

The warranty period lasts for the lifetime of a Residential Purchaser (30 years for a Commercial Purchaser). This warranty terminates automatically upon the sale of the property or the death of the last Purchaser.
 

WARRANTY REMEDIES

Should a covered defect occur within the warranty period, TITAN Fencing will, at its discretion, either repair or replace the defective Products. Alternatively, TITAN Fencing reserves the right to refund the amount paid by the Purchaser for the original Products, which will fulfill all obligations and liabilities under this warranty. TITAN Fencing will not cover labor charges or other expenses related to the installation or removal of either the original or replacement Products.
 

WARRANTY EXCLUSIONS

This warranty exclusively covers manufacturing defects in TITAN Fencing's material or workmanship and does not cover:

• Lack of necessary maintenance;

• Improper installation or inadequate reinforcement;

• Natural bowing of pickets due to heat;

• Distortion from external heat sources (e.g., reflected sunlight, grills);

• Normal weathering, defined as changes caused by sunlight and weather which may cause surfaces to fade, chalk, or accumulate dirt or stains;

• Variations in colour or pattern, including differences between replacement and original Products;

• Damage from pollution, chemicals, misuse, abuse, neglect, or improper handling;

• Damage by large animals or incompatible accessories;

• Ground or structural movement, distortion, settling, or collapse;

• Damage from foreign objects, natural disasters, or acts of God;

• Any other cause not due to manufacturing defects.
   

WARRANTY LIMITATIONS

THIS WARRANTY IS COMPREHENSIVE, REPLACING AND EXCLUDING ALL OTHER WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TITAN FENCING SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGE TO PROPERTY OR PERSONS, RESULTING FROM THE PURCHASE, INSTALLATION, OWNERSHIP, OR USE OF ITS PRODUCTS.

TITAN FENCING DOES NOT PERMIT ALTERATIONS OR MODIFICATIONS TO THIS WARRANTY UNLESS AUTHORIZED IN WRITING.
 

LEGAL RIGHTS

This warranty provides specific legal rights, and you may have other rights which vary from province to province. Some provinces do not allow limitations on how long an implied warranty lasts or the exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
